The United States Supreme Court heard arguments in the case of Schaffer
v. Jerry Weast a dispute between the Schaffers and the Board of Education
regarding whether parents or school boards/districts have the burden of
proving whether an IEP is adequate/appropriate.
According to National PTA, school districts should be responsible for
proving the suitableness of an individual education program because they
have greater expertise and resources that the average parent. School
districts are more likely to have access to the information that explains
their actions. Parents are not as likely to have the time or resources to
pursue their case. A decision is not expected until next summer. Additional
